Don't Be Distracted by Weinergate: The Scandalous "Judicial Insider Trading" of Justice Clarence Thomas, Wife "Ginni"

As we reported in January, Thomas appears to have "knowingly and willfully" filed falsified Financial Disclosure Forms which withheld disclosure of nearly $700,000 his wife received from the rightwing Heritage Foundation for the better part of the last 20 years. Only once it was pointed out publicly this year did Thomas bother to file "self-initiated amendments" to the forms he had signed just above the legal warning in bold and all caps which reads: "NOTE: ANY INDIVIDUAL WHO KNOWINGLY AND WILLFULLY FALSIFIES OR FAILS TO FILE THIS REPORT MAY BE SUBJECT TO CIVIL AND CRIMINAL SANCTIONS (5 U.S.C. app. § 104)"

While there has been little indication that law enforcement is actually investigating the crimes of the U.S. Supreme Court Justice (which, as we pointed out in January, are punishable by up to $50,000 and/or 1 year in jail for each instance of falsification), last Friday when Thomas' Financial Disclosure Form for 2010 [PDF] was released, the matter appears to have gotten shadier still, leading at least one government watchdog organization to describe what Thomas and his wife Virginia "Ginni" Thomas may be been doing as "Judicial Insider Trading."

Connecting the dots, it would seem the couple made huge profits from Thomas' participation and insider knowledge of last year's Citizens United ruling at the U.S. Supreme Court, as we'll show you below.

Supreme Court Justice Clarence Thomas has somewhat of a conflict just being a justice, concerning the very right-wing and very prominent political activities of his wife, Ginni. But that conflict is particularly a problem since the Supreme Court will almost undoubtedly be hearing a case against the Affordable Care Act, the law that his wife has been paid handsomely to fight. A Friday afternoon news dump consisting of his financial disclosure form highlights this little problem he has.

Seventy-four House Democrats have signed a letter to Clarence Thomas asking the Supreme Court justice to recuse himself from any deliberations on the constitutionality of the national health care overhaul, arguing that his wife's work as a lobbyist creates "the appearance of a conflict of interest."

…Given these facts, there is a strong conflict between the Thomas household's financial gain through your spouse's activities and your role as an Associate Justice of the United States Supreme Court. Thomas said he forgot to include her pay. He's not the first to 'forget' something. I'm sure the fact that he is conservative and Weiner is liberal had nothing to do with it.

Weiner proved he's a lying cheating scum bag. No body cares about his investigation into Thomas. It's just more partisan coverup for Weiner being a weiner.

Weiner just doesn't like that Thomas married a WHITE woman! Giggle

Democrats: Justice Thomas should recuse himself in healthcare reform case

A group of 73 House Democrats on Wednesday demanded U.S. Supreme Court Justice Clarence Thomas recuse himself from any case examining the constitutionality of healthcare reform.

Rep. Anthony Weiner (D-N.Y.) and 72 other colleagues wrote Thomas on Wednesday to ask him to sit out any Supreme Court review of President Obama's healthcare law, citing the work by Thomas's wife on behalf of efforts opposing that healthcare law.

"As members of Congress, we were surprised by recent revelations of your financial ties to leading organizations dedicated to lobbying against the Patient Protection and Affordable Care Act," the Democrats wrote. "We write today to respectfully ask that you maintain the integrity of this court and recuse yourself from any deliberations on the constitutionality of this act."

The letter reflects the growing political gamesmanship on both sides of the aisle in regard to court challenges to healthcare reform.

For instance, Sen. Orrin Hatch (R-Utah), a senior member of the Senate Judiciary Committee, has called for Justice Elena Kagan to recuse herself in similar cases. Kagan had worked in the Obama administration as solicitor general, and Hatch argued this would bias her in any consideration of the healthcare law.

The legal challenges to the new healthcare law are ultimately expected to reach the high court. Two federal district courts have upheld healthcare reform as constitutional, while two courts have struck it down, most recently a federal judge in Florida, who threw out the entire law over concerns about the provision requiring all individuals to have health insurance, the so-called "individual mandate."

The efforts by the Democrats — and by Hatch — would presumably tip the balance on the Supreme Court going into any hearing about the law. The court is seen as leaning conservative, with a 5-4 majority, though Justice Anthony Kennedy is often seen as a potential swing vote.

The Democrats' demand in this instance is based on concerns about the political advocacy conducted by Ginny Thomas, a Tea Party and conservative activist. Mrs. Thomas advertises herself as a lobbyist for "clients who want a particular decision — they want to overturn health care reform," the Democrats said.

"Given these facts, there is a strong conflict between the Thomas household’s financial gain through your spouse’s activities and your role as an Associate Justice of the United States Supreme Court," they wrote. "We urge you to recuse yourself from this case."

Hatch: Kagan should recuse herself from any challenge to healthcare reform

Supreme Court Justice Elena Kagan should recuse herself from cases considering whether the new healthcare law is constitutional, according to Sen. Orrin Hatch (R-Utah).

Hatch, a former chairman of the Senate Judiciary Committee, said that it would be most appropriate for Kagan to decline participation in cases on healthcare reform. Kagan served as President Obama's solicitor general before being named to the high court.

"I think that Kagan, who was the solicitor general at the time this was all done, probably should recuse herself, which means it might not be resolved by the Supreme Court," Hatch said Wednesday evening on Fox News. "That means the lower court decision will be the acting law."

Hatch's remark reflects the political gamesmanship that's sure to surround the Supreme Court's expected consideration of healthcare reform at some point.

A federal judge issued a ruling earlier this week striking down the law, Obama's signature domestic initiative, as unconstitutional. Federal circuit courts are expected to hear the administration's appeals of that and other decisions, and whichever side loses in those cases is expected to appeal to the Supreme Court.

Already, some lawmakers are asking for the Supreme Court to expedite its review of the new healthcare law, especially as it remains a potent political issue for Congress and regulators.

If Kagan were to recuse herself, it would presumably tip the court's scales toward conservatives, since Kagan is seen as a more liberal jurist likely to uphold the law. But Hatch, in speculating on how other justices might vote, said he wasn't sure that the outcome would necessarily be a close, 5-4 decision.

"I'm not convinced it has to go 5-4," he said. "I actually believe there are justices like Breyer and Ginsburg, and of course Kennedy, who will go with the four justices who are considered a little more conservative."


The House voted to repeal the healthcare law in January, but the Senate on Wednesday defeated a repeal effort.

i've looked up some of the sex scandels given to us by our congressmen and other leaders.

what weiner did was so far below the bar there HAS to be something other than those silly twitter pics.

and while it is sad... and while it does NOT present a pretty picture of us, as americans, it's my belief that the fact the guys name was Weiner really was the driving force.. twitpics of weiner's weiner was juts to much for people to let go of.

people have been caught with hookers and suffered less. people have been caught soliciting sex from other men and they weren't hounded liek weiner was.

i think they used him to get a few chuckles over his weiner - and Maybe to take the focus off of somethign else they didn't want the population to pay attention to. not sure what. don't much care. but as americans we ate it up like we do when they tell us some brittney or brangelina gossip.

You are right, his offense was minor compared to a lot of others. He nailed his coffin shut when he had the huge press conference one on one in his office and denied he knew anything about it. He also refused to report the 'hacking' to the FBI as Palin did when hers was hacked. He also could not 'recognize' if it was him in the picture.
So the sex part was minor, no weiner pun intended, was the HUGE amount of lying over lying was beyond what people could stand.

and yet clinton remained in office, and he lied under oath.

One of the networks trotted out one of their "political analyst/strategist" from the stable they keep backstage who said what sunk Weiner was a case of bad PR. He violated one of the cardinal rules of self-representation: Don't! It was said what Weiner should have done was to get on board some damage-control PR advisers who probably would have advised him to hold a press conference to admit and apologize; take a couple of questions; then leave before questions began delving too deeply; then STOP TALKING. No interviews, no comments, refer them to the news conference at which he had already said all he was going to say. In a couple of days the swirl of news events would have run right over that story, and it would be forgotten within a week.

Instead, he started his song-and-dance about being hacked; held "red herring" type news conferences for a week repeating the same theme, giving time for more contactees and photos to come to light; never would directly answer if that was indeed him; then ended the charade with a positively disastrous news conference with revelations that opened up more questions than were answered.

I've always heard that the man who represents himself in court has a fool for a client. Apparently, that goes for political scandals, too.

I agree, had he simply said "Yes, it's me, it was a joke, I'm sorry." It would have died as as news story. Instead he thought he could fake his way out of any blame only to get buried underneath the weight of all the lies. Yes, i would say he had a fool for a client.
